The unfortunate truth is that when it comes to birthing, there are a lot of factors outside of our control. Birth injuries can lead to a range of long-term complications that could affect your child. One question that often arises in relation to birth injuries is if they can lead to autism.

At O’Reilly Doherty, we provide guidance to families who suspect that a birth injury may have caused their child’s autism. However, we also believe it’s important for any parent to stay informed. Today, we take a look at Autism, its causes, and what to do in the event of a birth injury.

How to Identify Autism

When children display the presence of autism spectrum disorder (ASD), further evaluation is necessary. This assessment is typically carried out by a team of experts in the field including a psychologist, neurologist, psychiatrist, speech therapist, and others who specialise in diagnosing and treating children with ASD.

The team will conduct a thorough examination of the child’s neurological function and in-depth cognitive and language evaluations. Additionally, children with delayed speech development should have their hearing tested as hearing impairments can sometimes mimic the symptoms of ASD

What Causes ASD?

Autism Spectrum Disorder (ASD) is a complex condition that is believed to be caused by a combination of genetic and environmental factors. While the exact causes of ASD are not fully understood, researchers have identified several risk factors, including genetic predispositions and early developmental disruptions.

Studies have also shown premature birth, certain gene mutations, and certain environmental factors such as exposure to toxins like pesticides, heavy metals, and viral and bacterial infections are contributing factors to the development of autism in children. such as may contribute to the development of ASD.

How is ASD Diagnosed?

Diagnosis of Autism Spectrum Disorder (ASD) is typically done by a multidisciplinary team of healthcare professionals mentioned previously.

They perform a comprehensive assessment, including physical examination, developmental evaluations, cognitive and language testing, as well as gather information from parents and caregivers regarding the child’s behaviour and development.

Additionally, they might also conduct additional tests such as hearing tests to rule out other conditions that might be causing symptoms similar to ASD. The criteria for the diagnosis of ASD is based on the Diagnostics and Statistical Manual of Mental Disorders (DSM-5) published by the American Psychiatric Association (APA).

To be diagnosed with ASD, a child must demonstrate persistent deficits in social communication and social interaction across multiple contexts, as well as restricted, repetitive patterns of behaviour, interests, or activities. It should be noted that these deficits must be present in early childhood, usually before the age of 3.

How is Autism Treated?

ASD is typically treated through a combination of therapies and interventions. These may include behavioural therapy, speech therapy, and occupational therapy, as well as medications to manage associated symptoms such as anxiety or Attention-deficit/hyperactivity disorder (ADHD).

Behavioural therapy, such as Applied Behavior Analysis (ABA), is one of the most effective treatments for autism.ABA can help children with autism improve their communication and social skills, as well as their ability to manage their emotions and behaviours.

Many behavioural therapies are typically child-rearing practices such as giving stickers for every positive behaviour.

Speech therapy, reading short stories, and teaching kids essential words, can also help children with autism to improve their language and communication skills.

Occupational therapy can help children with autism to improve their fine motor skills, sensory processing, and overall independence. Examples of these are basic self-care, improving play skills such as coordination, reaching, b balance, endurance, communication, and cooperation with teams, and learning strategies such as grooming, cooking, dressing, and teaching kids basic self-care activities like brushing their teeth, and hair, and cutting their own nails.

It is important to note that each child with autism is unique and may require different types or combinations of treatments.

What Types of Trauma Are Linked to Autism?

Researchers have explored the connection between brain injury and autism. Such brain trauma experienced during pregnancy, at birth, or in early childhood may have an impact on brain development and raise the risks of autism.

One notable study conducted by the Autism and Developmental Disabilities Monitoring Network revealed a deep connection between cerebral palsy and autism. The study observed that seven percent of children with cerebral palsy had co-occurring ASD. Still, further research is needed to fully comprehend the relationship between trauma and autism.

How To Go About Birth Injury Claims

Pursuing a birth injury claim can be a daunting task, but with the right legal guidance and support, it is possible to achieve a successful outcome.

The first step in making a birth negligence claim is to gather all the necessary information and evidence related to the injury. This includes witness statements, medical records, and other pertinent or relevant information.

Next, consult a medical expert who can provide a professional evaluation of the injury and its potential causes. Doing this can help determine if the brain injury was indeed caused by medical negligence or malpractice.

Then, it is essential to seek the advice of a solicitor with experience in birth injuries. A legal team of experts with expertise in this area should be assigned to your case.

The set period for birth injury claims is for two years less a day, a day following the date of the incident. Get in touch with one of our O’Reilly Doherty solicitors to further discuss your case.

How Can A Medical Malpractice Solicitor Help If Neglect Has Caused Your Child’s Brain Injury Resulting In Autism?

A medical malpractice solicitor  can help to determine if birth negligence occurred, gather evidence and expert witness testimony, and fight for fair compensation on behalf of the affected child and family.

They can also provide guidance and support throughout the legal process and help to ensure that those responsible for the injury are held accountable for their actions.

Two landmark cases involved  13-year-old and 8-year-old boys battling for compensation as a result of alleged professional misconduct. This misconduct caused them neurodevelopmental defects resulting in autism.

The money from the settlements is being  used to secure their future and make sure that they will be able to have access to health care and therapy throughout their lives.
